This position serves as technical advisor to the Director of Contracts & Material Management and is the Team Leader on special projects on as needed basis and may be required to supervise procurement staff.
JOB DESCRIPTION:
I. MAJOR DUTIES & RESPONSIBILITIES
A. Contract Management
- Primary responsibility is to provide guidance, plans, policies for procurement, contracting, functions in support of the Corporate Office and HHSC healthcare facilities. This involves all procurement areas that involve but not limited to; Information Technology System and related services, Physician Financial Arrangements (PFAs), medical and facility equipment maintenance and repair, facility/building leases, and other goods and purchased services as needed. Additional areas of responsibility involve complex contracts that HHSC corporate contract is involved with, such as system wide goods, services and construction contracts, as well as smaller purchases of goods and services for the corporate office
- Receives, reviews and processes procurement requests (PRs) to ensure completeness and accuracy with statutory and regulatory requirements. Assists in the development of specifications, scope of services and other requirements of contractual documents. Develops, prepares and issues Invitation for Bids (IFB), for the more complex procurement actions within HHSC, Request for Proposals (RFP), Request for Quotes (RFQ), Short Form Agreements, Purchase Orders (PO), MOA’s and a multitude of miscellaneous contractual documents relating to the desired procurement action.
- Conducts contract technical and cost reviews/negotiations, and evaluation of bids/proposals. Coordinates with HHSC Legal Counsel in reviewing and analyzing the legal sufficiency of developing/pending contracts. Develops, prepares and coordinates contract award documents to include selected high dollar value and complex contract requirements with firm fixed price to cost-reimbursement contracts containing unique award and incentive fee arrangements. Assists the Corporate Director of Contracts & Materials Management with day to day assignments of workload and strategic planning.
- Performs the more complex contract administrative functions, i.e. monitors contractor’s performance. Negotiates, prepares and issues contract modifications, amendments, change orders. Reviews and processes contract claims, protests, appeals, alleged irregularities and other related documents and issues in coordination with the Director of Contracts and Materials Management and Corporate General Counsel
- Monitors and/or performs acceptance of the more complex contract requirements and coordination of payment procedures. Develops and maintains contract files and other appropriate contractual records. Performs closing, termination, storage and archiving requirements of contract documents.
- Performs acquisition planning; receives, reviews, distributes and files unsolicited proposals. Maintains/updates the Corporate level “Bidders List” file. Performs miscellaneous acquisition requirements to include but not limited to: Contract pricing reviews and determinations; value engineering practices; reviewing and developing contract provisions, terms and conditions; other actions, as identified by the Director of Contracts & Materials Management.
B. Acquisition Management
- Develops guidance, plans and policy for acquisition management and contracting programs utilizing comprehensive background and knowledge of procurement, contracting and purchasing rules, laws, policies, regulations, principles, concepts and methods. Assumes Team leader Responsibility for special reports and projects assigned by the HHSC, Director of Contracts & Materials Management.
- Provides policy and technical guidance on the more complex contract types purchase requests procedures, contract administration, commercial activities, acquisitions, performance work statements/specifications, contract violations, procurement ethics and a multitude of other acquisition concerns, issues and questions. Reviews acquisition problems and recommends solutions and/or corrective or remedial actions.
- Serves as the point of contact (POC) for business firms relative to acquisition interests for the corporate office. Represents the Corporate Director of Contracts & Materials Management in coordinating major acquisition policy matters with HHSC healthcare facilities.
- Analyzes and recommends acquisition management reviews. Develops and recommends acquisition management policies and procedures. Develops and recommends solutions to criminal or fraudulent contracting actions. Develops and maintains acquisition statistical data and prepares weekly, monthly, quarterly, and annual analyses and reports, using Microsoft Office applications as requested. Reviews HHSC healthcare facilities acquisition actions and provides assistance as required.
C. Other Duties
- Participates in Corporate staff assistance visits and technical management reviews at HHSC facility contracting offices. Serves as project officer for Corporate conference and training seminars.
- Prepares and presents briefings on acquisition management and contracting functions. Performs duties as a member of the procurement policy task group and subject matter expert subcommittees. Performs duties as a contracting representative in any specialized contracting area. Performs other duties supporting the mission and vision of HHSC, as assigned by the Corporate Director of Contracts & Materials Management.
- Acts as Administrator to the Contract Management System (SciQuest) for the system and maintaining the system on behalf of HHSC.
II. EDUCATION, EXPERIENCE, CERTIFICATION AND LICENSURE
A. EDUCATION: Graduation from an accredited four (4) year college or university with a bachelor’s degree.
Excess work experience as described under Specialized Experience, below, or any other responsible administrative, professional or analytical work experience which provided knowledge, skills and abilities comparable to those acquired in four (4) years of successful study while completing a college or university curriculum leading to a baccalaureate degree may be substituted on a year-for-year basis. To be acceptable, the experience must have been of such scope, level and quality as to assure the possession of comparable knowledge, skills and abilities.
The education or experience background must also demonstrate the ability to write clear and comprehensive reports, scope of services/requirements and other documents; read and interpret complex written material; and solve complex problems logically and systematically.
B. EXPERIENCE:
Specialized Experience: Four and one-half (4-1/2) years of progressively responsible work experience which involved one or a combination of the following: professional work experience in the development and/or administration of contracts:
- Preparing specifications for bids and quotes and proposals or formal requests for proposals for complex, high dollar contractual services, construction and equipment which involved the application of professional judgment and analysis in determining contract terms and conditions and/or developing proposals to meet such requirements.
- Evaluating, developing, negotiating, or revising the content of proposals and/or contracts and/or requests for proposals or other solicitation documents.
- Monitoring and evaluating the performance of contracted parties to ensure compliance with the terms and conditions stipulated in the contracts.
- Participating in procurement strategic planning.
Supervisory Experience: Two (2) years of supervisory experience which included (l) planning and directing the work of others; (2) assigning and reviewing their work; (3) advising them on difficult problem areas; (4) timing and scheduling their work; and (5) training and developing them.
*For Senior Contracts Manager positions, administrative aptitude rather than actual administrative experience may be accepted. Administrative aptitude will be considered to have been met for this level when there is strong affirmative evidence of the necessary administrative aptitudes and abilities. Such evidence may be in the form of success in regular or special assignments or projects which involve administrative matters (e.g., in planning, organizing, promoting, and directing a program providing staff advice and assistance); managerial interest demonstrated by the performance of work assignments in a manner which clearly indicates awareness of managerial problems and the ability to solve them; completion of educational or training courses in management accompanied by the application of principles learned to work assignments; management’s observation and evaluation of the applicant’s leadership and managerial capabilities; success in trial assignments involving managerial and/or administrative tasks.

III. DESIRED KNOWLEDGE, SKILLS AND ABILITIES
Knowledge of principles and practices of acquisition management; applicable State and Local laws, rules, regulations and standards; principles and practices of supervision and management. Knowledge of pre-award and post-award contracting policies and procedures to conduct reviews of full contracts, contracting plans and contract changes for propriety of acquisition method, contract type and documentation. Knowledge of hospital procurement, commercial business and industrial practices, (i.e. commercial subcontracting, procurement of raw material and costing techniques) related to the items procured sufficiently to analyze cost breakdowns and contract proposals. Knowledge of regulations and related material to develop local acquisition supplements, policies and procedures. Overall Knowledge of the more specialized and complex areas of Acquisition Management . Ability to convey requirements to other acquisition personnel in a Team Leader capacity.
Good written and oral communication skills to prepare written guidance and decisions to contracting personnel, contractors or higher level reviewing officials.
Ability to administer a centralized service of procurement, contracting and purchasing management; establish and maintain working relationships with representatives of other agencies, vendors and others to promote achievement of program goals; direct research and recommend changes in acquisition methods and practices, including drafting and recommending statutory changes.
IV. WORKING CONDITIONS AND PHYSICAL REQUIREMENTS
The position will work in an office environment with prolonged sitting. Occasional travel may be required to field activities for fact finding, activity review and determination of activity performance. The work is sedentary with occasional need to assist in transporting office supplies, relocating office equipment, etc.
